Flow charts

The IDAS process applicable to a particular development application varies depending on the nature of the application.

All development is exempt development unless it has been identified as self-assessable development, assessable development, development requiring compliance assessment or as prohibited development.

By answering the following five questions, an IDAS flow chart for the application for a development permit can be generated.

The flow chart that will be generated will provide you with an indicative timeline of the application.

1:	Is your proposal exempt development?	Help Under the Sustainable Planning Act 2009 all development is exempt development unless it is a self- assessable development, a development requiring compliance assessment, assessable development or prohibited development. Schedule 4 of the Sustainable Planning Regulation 2009 prescribes development that can not be declared to be development of a particular type (i.e. is exempt development). An example of exempt development is reconfiguring a lot if the planned subdivision necessary for the reconfiguration amalgamates two or more lots, under the Land Title Act 1994. Under the Sustainable Planning Regulations 2009, development stated in: •schedule 3, part 1 is assessable development •schedule 3, part 2 is self-assessable development •schedule 18 prescribes development for which compliance assessment is required. Schedule 1 of the Sustainable Planning Act outlines prohibited development.	Yes	No
2:	Is your proposal self-assessable development?	Help Self-assessable development is development: specified in schedule 3, part 2 of the Sustainable Planning Regulation 2009 declared in a local planning scheme that is not specified in schedule 3, part 2 of the regulation. An example of a self-assessable development is building work carried out by or on behalf of the state, a public sector entity or a local government (other than exempt development).	Yes	No
Your proposal involves assessable development and an application is required.
3:	Is the application required to be publicly notified?	An application must be publicly notified if it involves one or more development activities requiring impact assessment or the application is an application to which section 242 of the Sustainable Planning Act 2009 applies. An application may involve several development activities and each activity may have a different assessment category (i.e. code or impact assessment). The assessment category of a particular activity is determined by the planning scheme for the local government area or schedule 5 of the Sustainable Planning Regulation 2009. If any one activity for the application is prescribed as being impact assessable, the whole application is required to be publicly notified. Section 242 applies if a preliminary approval is sought and part of the application seeks to vary the effect of any local planning instrument for the land. 4:	Will the application involve referral to an IDAS referral agency?	Requirements for referral to a referral agency are prescribed in schedule 7 of the Sustainable Planning Regulation 2009.	Yes	No
5:	Is the application likely to involve an information request?	Under chapter 6, part 3 of the Sustainable Planning Act 2009, the assessment manager and any concurrence agency for an application can ask the applicant for further information in order to assess and decide the application. If an applicant receives an information request from the assessment manager, a concurrence agency, the applicant must respond to each and every request by providing: all the information requested part of the information requested together with a notice asking the requesting authority to proceed with the assessment of the application a written notice stating that the applicant does not intend to supply any of the information requested and asking the authority who gave the information request to proceed with the assessment of the application.
