Appeals against building and plumbing enforcement notices relating to the Sustainable Planning Act 2009 (pdf 2.6 MB), Building Act 1975  (pdf 1.1 MB) or the Plumbing and Drainage Act 2002 (pdf 772 KB) are decided by the Building and Development Dispute Resolution Committees.

If an applicant receives an enforcement notice they are not satisfied with, they must start an appeal within 20 business days of the notice being given.

For enforcement notices issued for a dangerous building or structure under the Building Act 1975, appeals must be started within five business days.

For enforcement notices issued for plumbing or drainage or an on-site sewerage facility that is dangerous, constitutes a health risk or is discharging incorrectly under the Plumbing and Drainage Act 2002, appeals must be started within five business days

Building enforcement notices

Building enforcement notice issued under the Building Act 1975 (pdf 1.1 MB) may be given to the owner of a building, structure or building work that local government believes is dangerous, falling down, unfit for use or occupation, filthy, infected with disease or vermin, or has been built without local government approval.

It may also be also issued to a person who does not comply with a particular matter under the Building Act 1975.

The range of matters building enforcement notices can be issued for are listed in the Building Act 1975.

Plumbing, drainage and on-site sewerage enforcement notices

Plumbing, drainage and on-site sewerage enforcement notices issued under the Plumbing and Drainage Act 2002 may be issued to the owner of a premise for plumbing, drainage or an on-site sewerage facility that the local government believes is dangerous, defective, inadequate for the site or has been installed without local government approval.

An enforcement notice may also be issued to the person who has performed the plumbing work or the property owner for plumbing, drainage work or on-site sewerage work if the work does not comply with the Plumbing and Drainage Act 2002.
