Lodging an application for an appeal |

To lodge an appeal to the Building and Development Dispute Resolution Committees, you must provide written notice to the Registrar with Form 10 - Application for appeal or declaration within the set time frames and pay the prescribed fee.
An application for appeal must be lodged within the timeframes prescribed in the Sustainable Planning Act 2009 ( 2.6 MB).
An application for appeal must be lodged within 20 business days upon receiving:
- a decision notice or information notice from a local government or private certifier under the Building Act 1975 or the Plumbing and Drainage Act 2002
- a notice about a development application for material change of use of premises for a prescribed building, or within 20 business days of the day the notice was required to be given to the applicant
- a notice about a decision or condition related to compliance assessment
- an enforcement notice issued under the Building Act 1975 or the Plumbing and Drainage Act 2002 (except as noted below)
- an infrastructure charges notice issued under a Priority Infrastructure Plan
- written notice of the requirement to pay an infrastructure contribution under planning scheme policy.
Other applicable time frames include:
- failure to decide a building development application (deemed refusal) - appeal can be lodged any time after the last day that the decision should have been made
- failure to decide a development application for material change of use of premises for a prescribed building - appeal can be lodged at any time after the last day that the decision should have been made
- appeals by advice agencies, for example Queensland Fire and Rescue Service, must be started within 10 business days of the day the decision notice or negotiated decision notice is given to the agency
- appeals against enforcement notices given for a dangerous building or structure under the Building Act 1975 or plumbing or drainage or an on-site sewerage facility that is dangerous, constitutes a health risk or is discharging incorrectly under the Plumbing and Drainage Act 2002 must be lodged within five business days after the day the notice is given to the applicant.
