If you have been given an information notice about a decision of the Plumbing Industry Council, you can appeal to the Queensland Civil and Administrative Tribunal (QCAT) for a review of the decision. Appeals often include:

  • refusal of an application for a licence
  • issuing of a provisional licence instead of a full licence
  • imposing or varying a condition on a licence
  • licence suspension or cancellation
  • disciplinary action taken against a licensee.

How to lodge an appeal

To start a review:

  • file an application for review of a decision with QCAT within 28 days of the decision
  • complete the relevant application form (Form 22—Application or referral or Form 23—Application to review a decision
  • lodge the application with the QCAT registry

Hearings

Directions hearings allow QCAT to consider preliminary matters and set times for a hearing and the supply of documents.You may attend directions hearings in person or by telephone if you complete a notice of telephone attendance. Parties should represent themselves whenever possible. If you wish to have a lawyer appear at a hearing seek the consent of the other party then contact QCAT.

Jurisdiction of QCAT

In reviewing the decision of the Plumbing Industry Council, QCAT may:

  • confirm the original decision
  • amend the original decision
  • substitute another decision for the original decision
  • set aside the original decision and return the matter to the Plumbing Industry Council with directions QCAT considers appropriate
  • for certain disciplinary matters, order the applicant to pay to PIC as stated amount.

A decision of QCAT is final.
